Low Testosterone Lawsuits: Settlement Timeline Updates

Banville Law reports that over 2,000 lawsuits have now been filed across the nation against AndroGel, Testim, Axiron, and other testosterone therapy treatments. The litigation alleges that these products have caused serious health complications among their victims, including blood clots, heart attacks, strokes, and even death.

The lawsuits were centralized in June of 2014 by a Multidistrict Litigation (or MDL) and have not yet come to settlement or trial. It is likely that the cases will not settle for quite some time. The litigation commonly states that the manufacturers of these testosterone drug products neglected to properly warn consumers and the surrounding medical community about their risks. Many victims also claim that advertising used for the products was misleading.

Because the proceedings are in their early stages, it is expected that additional cases will join in filing with both state and federal courts across the U.S. As trial approaches more closely, it is overwhelmingly expected that pressure will increase to make good faith attempts aimed at reaching settlements, although the manufacturers are currently refusing this option.

All negotiations for settling the testosterone lawsuits will be based on bellwether trials, where a jury will assess all information provided for certain cases chosen to go to trial. The jury is expected to consider factors such as the nature of claimed low T drug injuries, the severity of the sustained damage, and the financial impact of dealing with that damage.

The MDL is presided over by U.S. District Judge Kennelly of the Northern District of Illinois. The AndroGel trials are expected to begin later this year, with cases filed against other testosterone drugs following mid-year of 2017. As common in complicated pharmaceutical trials, the AndroGel cases are Bellwether lawsuits, which are designed to assist with foresight about how juries may respond to specific testimony or evidence, and reduce repetitive discovery. It is hopeful that this process will help to facilitate victim’s settlements, however, if this does not occur, the cases will then return state court for resolution.
