The first and most basic step in achieving a severance to an erring spouse is by contacting a family lawyer. Determining the proper grounds for divorce is another matter, and reasons can include adultery, mental illness, drug or alcohol abuse as well as physical or mental cruelty to name a few. Once the grounds for divorce are understood and determined, the necessary papers for the said petition have to be filled out and served to the sheriff's office. The defendant spouse is given 35 days to respond. The process may take a while if the other spouse files a counterclaim. This however, may work the other way around if the spouse does not answer. A default request judgment may then be requested from the court. If everything else fails and the abusive spouse contests the grounds or any legality thereof, the family lawyer will then appear on behalf of the client.
