Dr. Jose Nabut Accused Of Sexual Assault in Lawsuit Filed in Florida

Miami, Florida – Dr. Jose Nabut, a primary care physician believed to be employed with Physicians Associates and Fox Medical Center, Inc., faces allegations of sexual assault and failing to provide safe healthcare to his patients. The lawsuit, filed in the Eleventh Judicial Circuit in and for Miami-Dade County, Florida under case number 2019-033433-CA-01, Jane Doe v. Jose Nabut M.D., Fox Medical Center, Inc. and Physicians Associates alleges that, Defendant Jose Nabut engaged in unlawful, harmful, and offensive sexual conduct and contact upon Jane Doe.

The law firms Gordon & Partners and Laffey, Bucci & Kent, a Philadelphia based firm specializing in representing survivors of sexual assault filed the lawsuit. Jane Doe, a 60 year-old Miami-Dade Resident, alleges her primary care physician sexually assaulted her in August of 2018. Jane Doe went to Dr. Nabut’s office to pick up paperwork when Dr. Nabut insisted he meet with her privately. Dr. Nabut then performed an additional examination of Jane Doe where he began to touch her inappropriately and sexually assault Jane Doe including digitally penetrating her vagina. Jane Doe reported the matter immediately to the police.

Florida Law has a strict zero tolerance policy for the behavior that occurred to Jane Doe. As outlined in Florida Statute 458.329:

“The physician-patient relationship is founded on mutual trust. Sexual misconduct in the practice of medicine means violation of the physician-patient relationship through which the physician uses said relationship to induce or attempt to induce the patient to engage, or to engage or attempt to engage the patient, in sexual activity outside the scope of the practice or the scope of generally accepted examination or treatment of the patient. Sexual misconduct in the practice of medicine is prohibited.”

Many individuals report claims, but their complaints tend to be grossly mishandled and/or ignored. Physicians, Associations, Hospitals, and State Medical Boards must do more to protect patients from sexual assault and abuse.
