The process generally starts with the owner and the buyer entering into a contract which sets out the terms on which the property is to be sold. Once contracts have been agreed upon and exchanged, the buyer and the seller are legally obliged to finish the transaction. Until that point, however, either party is free to withdraw without any legal liabilities.

When contracts have been exchanged, the buyer must also pay a deposit. Usually this amounts to about 10% of the full purchase price, which the seller is entitled to ask. In cases where this might not be possible, the help of a conveyancer is useful to figure out the best course of action. To complete the conveyance process, the buyer has to transfer the full amount of the purchase to the seller. Once the money has been transferred, the transaction is complete, and the keys will be handed over to the seller. If either party fails to complete the transaction by the agreed date, they will be in breach of the contract, and the defaulting party will have to compensate the other for any financial loss suffered (in addition to paying a penalty under the terms of contract).
