New Jersey shoplifting attorney Adam M. Lustberg (https://www.lustberglaw.com/blog/shoplifting-laws-in-new-jersey/) releases a new article explaining the shoplifting laws in New Jersey. The lawyer mentions that shoplifting happens more often than most people think. In fact, more than 10 million people have been caught shoplifting in the past five years. This is according to the National Association for Shoplifting Prevention.

“In New Jersey, a shoplifting charge, like most theft charges, can result in severe penalties, fines, and even jail time. Shoplifting merchandise with a combined retail value of less than $200 can result in a $1,000 fine and/or up to six months in jail. Stealing more than $500 worth of merchandise is considered a third-degree crime and can result in 3-5 years of prison time and a fine of up to $15,000,” says the New Jersey shoplifting attorney.

The lawyer also explains that retail fraud in New Jersey constitutes a lot of different actions. These actions include the removal of the original packaging and hiding it among other merchandise, attempting to remove security tags, altering a price tag, and placing an item inside the purse, pocket, or body while walking around the store.

Attorney Adam M. Lustberg adds that in New Jersey, shoplifting more than $75,000 worth of merchandise is punishable by 5-10 years in state prison. The judge may also order the convicted person to pay restitution. Owners of the establishment can sue the offender for damages in civil court as well.

In the article, attorney Lustberg says that first-time offenders may be able to gain entry into a diversion program that can get the criminal charges against them dropped. These programs may include community service or counseling. If the offender is successful in completing these diversionary programs, they may be able to get their charges dropped.
