Power Morcellator Uterine Cancer Lawsuits Spur Coverage Denials By Insurance Companies

Banville Law reports on the removal of insurance coverage for laparoscopic power morcellator devices when they are used for hysterectomies and myomectomies by Aetna Insurance Company. This decision comes after an increasing number of lawsuits have been filed against various manufacturers of the device, alleging that it can expose and spread cancer cells during gynecological surgeries.

The United States Food and Drug Administration also issued a warning statement against these devices, with much the same message, indicating that women should refrain from undergoing laparoscopic power morcellation procedures on uterine fibroids because of the risk of discovering and disseminating previously undetected cancer cells. They estimated that about 1 in every 350 women who undergo these procedures have uterine sarcomas that they were unaware of before the surgery. The spreading of these cells could cause an accelerated, high-grade cancer that is difficult to treat and often fatal.

After announcing this decision, Aetna explained that they were specifically ending coverage of morcellators, which were used during gynecological surgeries, as the FDA’s warning had discussed. They informed physicians that they were still open to discussions over other circumstances that power morcellators might be used. Physicians would need to provide special clearances for these alternative procedures, which Aetna could decide whether or not to cover on a case-by-case basis.

Power morcellator lawsuits continue to add up, and Ethicon brand power morcellator suits have been consolidated in multidistrict litigation number 2652 in the United States District of Kansas. They are being overseen by Judge Kathryn H. Vratil, and are expected to continue to increase in number as they await trial. Plaintiffs involved in the MDL share similar allegations, which made this consolidation possible. It is hoped that the consolidation will help to fast track the litigation by avoiding different rulings from multiple judges and avoid duplicate discoveries.
