A law firm based in Edmonton, Alberta, Canada, is proud to announce that they have helped a client be awarded day to day care of her child. This was following a request for a Parenting Variation Order made by the mother. The decision has been very much welcomed by the mother in this case.
H. Kim Doniger, founder of HKD Law, says: "It is very rare for a court to agree to a variation in parenting orders when the child is properly cared for by both parents under the agreement of a previous order, as was the case in this situation. However, circumstances have arisen that required the mother to put in a variation application, believing this to be in the best interest of the child. We are happy to say that the judge has agreed with our presentation of the case."

In this particular case, the outcome was favorable for the law firm and the client, as they were able to properly demonstrate that the mother's wishes were in the best interests of the child.
According to the judge presiding over the case, "In the result, it is my view that it would be in the best interests of the Child to grant the Mother day to day care of the Child, and to grant the Father parenting time every second weekend together with additional parenting time for summer vacations and holidays." This decision was made after HKD Law was able to demonstrate that the child would experience disruption if existing arrangements were to continue.
As with many cases, the root of this particular problem was found in a breakdown of communication between the mother and father after separation. While the law firm agrees with the courts that parenting classes may be needed, their main concern is for the safety and happiness of the child concerned.
