TheProductLawyers.com reports on a lawsuit which has been filed in the Southern District Of Alabama against Johnson & Johnson subsidiary Janssen Pharmaceuticals. The suit is filed under case number 1:15-cv-00636 in relation to type-2 diabetes drug Invokana. The plaintiff filing the suit indicates that she used the SGLT2 inhibitor drug beginning in December of 2014, and, shortly after, developed diabetic ketoacidosis.

Diabetic ketoacidosis is a dangerous and potentially fatal medical condition in which the body has too much acid in its bloodstream. It can come on suddenly, in just 24 hours, and cause a comatose state or even death if it goes untreated. The FDA has asked that SGLT2 inhibitor users be aware of signs of oncoming ketoacidosis, which, according to the Mayo Clinic, consist of “excessive thirst, frequent urination, nausea and vomiting, abdominal pain, shortness of breath, fruity-scented breath, and confusion.”

The plaintiff claims that she was unaware of the risk of developing this condition for consumers taking Invokana. Details found within court documents show that she additionally alleges that Janssen was negligent by neglecting to properly warn the public about Invokana’s side effects and not properly studying the drug, as well as marketing the drug “off-label” (for uses not approved by the FDA) to treat type-1 diabetes and lower blood pressure.

The lawsuit bears striking similarities to another which was filed in the Philadelphia Court of Common Pleas under number 15-12-00653. The plaintiff, in this case, a man, claims that he began taking Invokana in November of 2014, and, just 3 months later, was diagnosed with ketoacidosis.

The lawsuits follow a recent safety communication which was issued by the U.S. Food and Drug Administration (FDA) which specifically discussed a link to ketoacidosis, and required manufacturer Janssen to add additional warnings to Invokana’s label.
