Child custody has different definitions based on who gets to raise the child and who gets to make the important decisions in their lives. It is also further split based on whether the aforementioned decision-making power is granted to one or both of the parents. Physical custody refers to the parent’s right to have a child live with him or her. The parent who is granted physical custody is given the opportunity to control the day-to-day upbringing of the child. This is most desirable as it allows the parent to be in close proximity to their loved ones at all times and to watch them grow into healthy adults. However, there are certain limitations to physical custody. Certain influential decisions about the children’s lives such as schooling, religion, and medical care fall under the definition of legal custody. A parent with legal custody has the right and obligation to make the major, potentially life-altering decisions for their children.
Physical custody and legal custody can either be granted solely to one parent or it can be jointly shared by both parents. This distinction is called sole custody and joint custody. In most cases, sole physical custody is granted to one parent while both parents are granted joint legal custody so that they can have a say in shaping the child’s future. Joint legal custody, joint physical custody, or joint legal and physical custody can exist if the parents are divorced, separated, or no longer cohabitating.
In some cases, when one parent is declared unfit for parenting, one parent may be granted sole legal custody. This is only possible if one parent and their legal team submit evidence that the other parent fulfills a certain list of criteria that the court has decided makes a parent unfit for raising a child. The decision of sole legal custody is not made solely on the feelings that one side may have for the other. To build a case to appeal for sole legal custody is a tough uphill legal battle that requires a dedicated attorney, such as Lisa Amundson.
Child support lawyer Lisa Amundson talks about child custody, parenting time, and visitation by saying, “When two hearts grow farther apart, there may be lasting bitterness that can prove toxic to the mental as well as physical health and wellbeing of a young one. Though nobody enters a marriage with the expectation that it is going to fail, human nature is not always predictable and there is always the possibility that the idyllic family life that was promised may not come to fruition. The law has recognized a need to step in at such instances to protect the future of the young children caught in the crossfire of verbal and emotional accusations. According to Section 518.17 of the 2020 Minnesota Statutes, titled Custody And Support Of Children On Judgment, Minnesota Law makes decisions based on the best interests of the child. Our responsibility at the law firm is to make the best and strongest case for our clients to get the right to be in their children’s lives to the best of their abilities. As a child custody lawyer, I have helped countless families move on from a bad separation and live fulfilling lives which involve a healthy upbringing for their children.
