The lawyer explains that a DWI charge in New York is specifically related to impaired driving as it relates to alcohol. If a person is driving in New York, they may be charged with DWI if their blood alcohol content (BAC) is at or above 0.08%. DWAI, on the other hand, can be used against a driver who has not reached the 0.08% BAC limit but is still considered impaired.

Attorney Jason Bassett adds that there are three types of DWAI in New York: DWAI, DWAI drugs, and DWAI-combination. If a person has been found driving with a BAC between 0.05% and 0.07%, they may be charged with DWAI. If a person has been found operating a vehicle under the influence of recreational or prescription drugs, they may face DWAI-drugs charges which is a misdemeanor. And if a person has been found to have been driving under the influence of both alcohol and drugs, they may face charges of DWAI-combination which is also a misdemeanor.
