The lawyer mentions that the different charges and penalties for DWI on Long Island can be complicated. These penalties can vary depending on the accused’s blood alcohol content (BAC) under New York laws.
“Your charges can differ depending on the results of the chemical test. However, a law enforcement officer declaring that you are in an intoxicated or impaired state can already be enough cause for you to be charged with an impaired driving offense,” the Long Island DWI/DUI attorney says.
The lawyer explains that in New York, a person may be guilty of driving while ability impaired (DWAI) if they are caught driving or operating a motor vehicle while having a BAC of more than 0.05% but less than 0.07%. They may also face a DWAI charge if the officer declares that their driving ability is impaired.
Attorney Jason Bassett says that for a DWI, a person may be charged if they test for a BAC of 0.08 or more, or if the officer declared the person to be in an “intoxicated condition”. Commercial drivers are not allowed to operate a vehicle if their BAC is more than 0.04, and those under 21 years of age should not operate a vehicle with a BAC of more than 0.02%.
In the article, attorney Jason Bassett adds, “A person may be held guilty of a Combination-DWAI if they operated a motor vehicle and if they test positive on a chemical test for both alcohol and a controlled substance of a combination of controlled substances under New York State Public Health Law 3306. They may also face the same charge if the effects of alcohol and controlled substance or the combination of the controlled substances are proven to have hindered or impaired their ability to drive judiciously.”
