The lawyer mentions that child support can be a contentious matter during a divorce process. Ensuring the well-being of the child or children in the family should be a priority for both parents.
“Child support must be considered after child custody is determined. It can be difficult and stressful to determine fair and appropriate support for your children. There are specific laws in New York that govern child support. Even if one or both parents agree to make a deviation from the rules, documentation is required. Otherwise, it could be thrown out,” says the New York City child support lawyer.
According to the lawyer, New York uses a formula to determine the amount of income that a parent must give to the custodial parent. The New York Child Support Standards Act (CSSA) outlines this formula.
Both parents must pay 17% of child support if their combined income is more than $143,000 and one child; 25% for two children; 29% for three and 41% respectively; minimum of 35% for five children and more. The CSSA allows the court to deviate from the standard if the combined incomes of the parents exceed $143,000.
The lawyer states that child support payments are typically made by the non-custodial spouse to the custodial parent. Even if they share equal physical custody, one spouse could be required to pay child support to the other.
In the article, attorney Mohr adds, “Even if your income isn't from work, it could still be there. New York's workers' compensation includes pensions, fellowships, and annuity payments. This income can be used for child support purposes. A court will calculate your payments if you have received disability, unemployment, social insurance, veterans, and retirement benefits. Public assistance is, however, not income. All public assistance received from the state is taken out of the total parental income.”
