The lawyer mentions that child abuse laws fall under the criminal code. Under Family Court Act, Section 1012 (e), an abused child is one whose parents or guardians inflict physical, mental, or sexual abuse on the child. Child abuse can also constitute maltreatment and neglect that puts the child in serious harm.
“Child abuse or neglect reports are filed when there is reason to suspect that a child has been abused or if someone has information regarding an instance of child abuse. Mandated reporters are required to make their suspicions of child abuse known. These suspicions might be cultivated by certain circumstances involving the child, the condition in which the child is living, or facts presented to them by the child,” the article from the New York City family law attorneys says.
The lawyers explain that certain professions are required by law to act as mandated reporters for any suspected child abuse in New York. If these mandated reporters fail to report their suspicions, they can be held accountable in the criminal and civil legal systems. Mandated reporters are required to make a report when presented with reasonable or substantial doubt to suspect a child is being abused.
Attorney Martin Mohr says that professions that require workers to act as mandated reporters include social service workers, licensed marriage and family therapists, registered physician’s assistants, school officials and teachers, residential care workers, and many others. The lawyer adds that the common perpetrators of abuse in children often look like everyone else.
Attorney Ethan Steward adds, “Even though it’s controversial, New York has a statute of limitations for child abuse cases. If child victim is not able to file a claim against their abuser in a timely manner, they may be barred from seeking justice. A civil case involving child abuse can only be filed within five years of the person becoming the majority. This means that it must be filed before the victim turns 23.”
