The lawyer mentions that according to the Black’s Law Dictionary, an annulment means an event or judgment that is treated as if it never happened. Fraud is the making of intentional misrepresentation, with the knowledge that the other party will rely on it, and attaining the other party’s consent as a result. The lawyer explains that if an individual uses fraud as a ground for annulment, one question will be whether the thing they were lied to is important enough to count as fraud. However, in Florida, if the marriage has been consummated, fraud is not allowed to be used as a basis to annul the marriage.
Attorney Russell D. Knight adds that another ground for annulment is duress. Duress happens when there is some level of pressure strong enough to remove the willful consent of one party. The duress must also happen throughout the entire process of the wedding.
In the article, attorney Knight also discusses bigamy. Bigamy is also another ground for a marriage annulment. This term simply means that a person is not allowed to marry again if they are still married. In Florida, bigamy is considered a felony in the third degree.
The divorce attorney also adds, “What happens if a marriage is annulled? Well, neither spouse is eligible for any kind of benefits for spouses. This is especially important as it relates to wills and life insurance policies. This begs the question ‘can an annulment happen after a person has passed?’ No one knows the answer to this particular question as no court has addressed it yet.”
