According to the lawyer, Florida state law governs how child maintenance works regardless of whether parents are divorced or not.

"Florida allows the court to enter child support orders and provides some guidelines of what child support orders must include. The statute immediately instructs that the courts have the power to award child support in an amount pursuant to guidelines in Florida Statute Section 61.30," says the Naples divorce attorney.

The lawyer explains that Florida's child support guidelines follow a specific formula. To determine the amount of child maintenance, the net monthly income will determine each parent's share. This means that if one parent does not have 20% of the overnights, then that would be the percentage of the child support that the non-custodial parent has to pay.

Attorney Knight points out that it is necessary to determine one's net income before reducing child support. There are several deductions that may be allowed from gross income. These deductions include mandatory union dues, health insurance payments (exclusion payments for coverage of minors), federal insurance contributions, and self-employment tax.
