ZofranLegal.com reports that the more than 230 plaintiffs involved in the ever growing Zofran birth defect litigation are demanding information which may be critical to their case from the drug’s manufacturer, GlaxoSmithKline.
The plaintiffs and the defendant are in the middle of negotiating which questions can be asked on a “Plaintiff Fact Sheet”, which will be given to each family that has chosen to file a lawsuit. In response to this fact sheet the company will be required to answer their own set of questions on a “Defendant Fact Sheet”. The questions that can be asked on this form are also currently being negotiated.
A draft of the Defendant Fact Sheet has been proposed. Plaintiffs are requesting that the company provide information such as a copy of the master letter of the “Dear Doctor” letters sent out regarding Zofran, a list of all of the medical professionals this letter was sent to, copies of any responses to the letter that the company received, a list which identifies all sales representatives or any other employees who “came in contact with the Treating Healthcare Provider(s) in connection with Zofran…”, and a list of any medical professionals that were in some way compensated by GSK for a purpose relating to Zofran.
In addition to all of this, plaintiffs are requesting that the company release copies of any adverse event reports for Zofran. Adverse event reports may show that doctors reported birth defects after prescribing the drug to their patients and may also reveal any additional documentation that the company created in response to this report.
This information, in particular, may prove vital for the plaintiffs, who are all alleging that exposure to Zofran in the womb resulted in a birth defect in an unborn child. Birth defects include ventricular septal defect, atrial septal defect, cleft lip, cleft palate, clubfoot, kidney defects, respiratory distress syndrome, and ear deformities.
