Zofranlegal.com reports that yet again, a family has filed a lawsuit against the drug manufacturer GlaxoSmithKline, alleging that their son’s birth defect was caused by his exposure to Zofran while still in the womb.
In this case, which was originally filed under case number 2:15-cv-04536-JLL-JAD in the U.S. District Court for the District of New Jersey and was later consolidated with hundreds of other complaints in Massachusetts under MDL 2657, a mother claims that Zofran caused her son to develop a condition known as clubfoot.
Clubfoot is a congenital defect which results in the malformation of the foot, leaving it turned inward so that the bottom of the foot is sideways. While the condition isn’t painful during infancy, if the defect is not corrected the child will never be able to walk. The treatments for this condition include manual manipulation of the muscles, stretching exercises, casts, leg braces, and in severe cases, surgical changes to the tendons in the legs. The treatments can cause the babies quite a bit of pain and it may be years before the process is considered complete.
In this particular case, the child underwent a tenotomy and has to wear a metal brace which has left him with pressure sores and blisters. The metal hits his crib at night and has left him sleep deprived. His parents also report that his social skills are underdeveloped because other children won’t play with him and they have had difficulty finding a school that is able to take care of his needs.
The plaintiffs claim that GSK has received “hundreds of reports of birth defects associated with the non-FDA-approved Zofran in pregnant women.” According to their complaint, the company failed to disclose these reports to doctors or pregnant women.
