Instead, Florida’s courts are using terms such as parenting plans and time sharing. These terms have been changed to reflect a growing number of cases that swing in favor of both parents instead of just one.
“Instead of designating one parent as the custodial parent who takes on the primary childcare and decision-making duties,” Mr. Vigodsky explains, “courts now assume that both parents will retain responsibility for the care of their minor children and that both will participate in making decisions related to their health, welfare, and education.”

Parents must show they’re reasonable and responsible enough to abide by the outcomes of the case, fit to be a moral and loving parent, and be financially stable enough to support the child or children.
Mr. Vigodsky then detailed more specific criteria that courts evaluate. One specific factor that is weighed in courts is where both parents live and if that causes a strain on the parenting plan. Others were obvious, such as whether the children will be in a home with substance abuse or personal abuse of any kind. These factors are among the most important in creating a parenting plan. If a parent is deemed unfit due to failing any of this criteria, they will most likely lose their rights to custody.
