Sexual Assault Attorneys File Multiple Lawsuits Against Massage and Spa Franchise

AbuseGuardian.com reports on the rising number of lawsuits filed against Massage Envy Franchise by various plaintiffs across the country alleging negligence of the company due to multiple sexual assaults which plaintiffs claim have been committed there by massage therapists.

Massage Envy is a massage and skin care franchise company based in Scottsdale, Arizona, which was founded in 2002. They have over 1,000 franchise locations in 49 states and are the largest employer of licensed massage therapists in the nation. The company uses a membership-based model to offer affordable “spa” services to their clients. Recently they went through a rebranding in November of 2015, removing the use of the terms “luxury”, “pamper”, and “treat” from their vocabulary. The company is instead focusing on changing the public’s view of massage and facials to incorporate them as part of a regular health routine with clients through their “Because Everything” campaign.

The company recently made headlines when they named Joseph Magnacca, former CEO of RadioShack, their new CEO this January. Yet, for the past couple of years, Massage Envy has been making the news as multiple plaintiffs from across the country have filed lawsuits against them claiming negligence. Several clients have alleged that they were sexually assaulted by a Massage Envy therapist while attending a massage session. Many of the lawsuits make similar allegations of negligence, claiming that the franchise did not make enough of an effort to prevent the assault from occurring. In these cases, filed under numbers 1509025459, 150800409, 1509025324, 150703869, 150703385 in the Court of Common Pleas Philadelphia County, all of the plaintiffs name the same perpetrator, despite some of them having already allegedly reported that therapist to the Massage Envy management. These plaintiffs are outraged that the proper authorities were not contacted to prevent further assaults by the therapist.

Unfortunately, these allegations are not uncommon. There are lawsuits filed against Massage Envy franchises in at least 15 other states according to court documents. Many of the offenders have already been charged and convicted, yet plaintiffs are looking for more answers from Massage Envy as to why the alleged incidents occurred in the first place.

Attorney Brian Kent understands how serious allegations of sexual assault are. Both he and his firm are devoted to protecting the dignity, safety, and on-going security of each of their clients. He comments: “One of the most difficult challenges for a sexual abuse survivor is confronting the reality of what happened. We treat each client with individual attention and compassion.” Kent and his firm are currently representing several clients in sexual assault claims against Massage Envy.
